Shand Taylor Lawyers has extensive experience in retail, commercial, and industrial leasing transactions throughout Queensland. We act for a number of prominent owners of shopping centres, industrial complexes, and commercial office buildings as well as a wide range of tenants from national chain stores, international companies and small businesses.

Our Expertise

 

Our team regularly assists clients with the following:

  • Drafting, negotiating, and finalising agreements for lease, leases, fit-out and incentive deeds, guarantees, and statutory disclosure statements on behalf of landlords, including the follow up of ancillary requirements such as bank guarantees and arranging mortgagee consent and registration of leases.

  • Reviewing and negotiating leases and associated documents on behalf of tenants.

  • Complying with the Retail Shop Leases Act 1994 (Qld), including meeting legislative timeframes, drafting compliant documents, and preparing and reviewing statutory disclosure statements.

  • Leasing of specialty sites such as service stations, licensed establishments, airports, childcare centres, and telecommunication sites.

  • Licensing of premises, common area trading, and car spaces.

  • Advising on, reviewing and preparing documents relating to assignment, surrender, and subletting of leases.

  • Reviewing and negotiating leases for franchisees.

  • Issuing and enforcing notices to remedy a breach of lease covenants.

  • Recovering arrears and damages from defaulting tenants.
